The Indian Supreme Courts ruled to overturn the repeal of their law banning gay sex- Section 377. One could argue over the need to change the law and points of view will vary of course. But what nobody seems to be remembering is the reason behind the ruling. The courts didn’t rule the way they did because they hate and want to oppress gays. They simply had no choice but to rule according to the law which states that the old law is still constitutionally valid and can only be changed or erased through Parliament, not the courts. So if the gay sex law is to be changed it must be a change wanted by the majority of Indian citizens through the legal process. And for this I commend India for following its laws because in the United States the Courts feel its their duty to rule and interpret the law, not the people.
